PRIVACY IS IMPORTANT!
At SourceMonks, we take the handling and security of your personal data very seriously. We did so even before the legal obligations provided a clear framework for this. And even now, our policy and its implementation are critically reviewed several times a year as part of our business operations.
It is inevitable that, if you are registered with us or do business with us, we will process your data. After all, our work is mediation, and for that we really need to have a minimum amount of personal data about you, but also, for example, your CV, in order to be able to inform you properly about our services and opportunities.
SourceMonks will only share your personal data with third parties if this is necessary for the performance of the agreement with you or to comply with a legal obligation. And, of course, we will share your data, with your express consent, in the context of acquiring and executing an assignment.

SourceMonks takes the careful handling and protection of your personal data seriously in its services. With this privacy statement, we would like to inform you about what data we collect, how we do so (directly or indirectly), why we do so (for what purposes), on what basis, and how we further handle your data.
WHY DOES SourceMonks NEED DATA?
SourceMonks processes your personal data in order to provide our services (interim mediation). SourceMonks uses the collected data for the following specific purposes:
● To assess the suitability and availability of candidates, which may also involve the use of (publicly accessible) social media.
● To be able to call or email candidates if necessary to perform our services.
● For a (potential) agreement with a candidate, for the preparation, conclusion and execution of a contract for services.
● To provide SourceMonks' clients with suitable candidates and, subsequently, a (potential) agreement with the client.
● To comply with legal requirements in mediation, such as identification, labour law, tax law, and social security law.
● For establishing and maintaining business relationships.
● To send newsletters to candidates and customers.
● Maintaining and improving the website.
● For the realisation of other business objectives, such as improving services, generating management information, conducting satisfaction surveys, and access security.
WHAT DATA DOES SourceMonks PROCESS?
SourceMonks processes your personal data because you have provided this data to us verbally or in writing, or by filling in the contact form or adding it to “My SourceMonks” via our website. SourceMonks also collects data via third parties, such as the social media channel LinkedIn.
This may include candidates who:
● Name and address details, e-mail address and other contact details.
● Date of birth, age, gender, nationality, language.
● CV, education and work experience.
● LinkedIn profile.
● Chamber of Commerce number and VAT number/VAT ID.
● Bank account.
● National Insurance Number.
● Information about availability, rate indication, preferences, position/position group.
● Other personal data provided by creating an account on the website, in correspondence, and by telephone.
● IP address. This may be for business relations:
● Name of organisation.
● Email address and telephone numbers.
● LinkedIn profile.
● Position/position group.
BASIS FOR PROCESSING PERSONAL DATA
Organisations may only process personal data if they have a legal basis for doing so. We process your personal data on the following four legal bases:
1. Consent: for passing on candidate details to a (potential) client. You may withdraw your consent at any time.
2. Legitimate interest: SourceMonks processes personal data to pursue its legitimate interests, namely:
● Establishing and maintaining business relationships.
● Performing recruitment and selection services (for example, by processing data obtained through third parties).
● Providing information about services, other activities and/or professional information (e.g. via e-mail and digital newsletters).
3. Agreement: necessary for the performance of an agreement by SourceMonks, for example, a contract for services or a service agreement.
4. Legal obligation: if we receive a legitimate request to provide data to a competent authority. We are also legally obliged to retain personal data (for a long period of time) in our financial records, in accordance with tax legislation.
SHARE WITH OTHERS
SourceMonks will only share your personal data with third parties if this is necessary for the performance of the agreement with you or to comply with a legal obligation. We enter into a processing agreement with companies that process your data on our behalf to ensure the same level of security and confidentiality of your data. The processors may only process the personal data on our behalf and under our supervision, solely for purposes that we determine under strict confidentiality. SourceMonks remains responsible for these processing operations.
SourceMonks uses a processor that stores its data in the United States based on standard contractual clauses. This means that there is an adequate level of protection for the processing of personal data.
When we collaborate with freelancers, temporary staff or partners who are not processors because they are under our direct authority, and it is necessary to exchange personal data, we enter into a confidentiality agreement.
HOW LONG DOES SourceMonks STORE DATA?
SourceMonks does not retain your personal data longer than is necessary for the purposes for which it was collected and complies with applicable laws and regulations. Once the retention period for personal data has expired, it is destroyed or anonymised.
SourceMonks applies the following retention periods:
For recruitment and selection via external sources: Personal data that SourceMonks has not obtained from you in the context of recruitment and selection will be retained for a maximum of 28 days, unless you give your consent for that data to be retained for longer.
When consent for processing has been granted: Given the nature of our services and your interest as an interim professional in building a long-term relationship with SourceMonks and remaining visible for assignments, your data will be retained for a maximum of 5 years if no agreement has been concluded in the meantime. However, you will be regularly asked to update your data (update your CV) and to indicate your availability. If you make use of this option, the date of this update will be considered the start of a new 5-year period.
For data subject to statutory retention periods, the period is often longer. For tax purposes, for example, this period is seven years.
VIEW, MODIFY OR DELETE DATA
Under the General Data Protection Regulation, you have the right to view your personal data and, if necessary, have it amended or deleted. In addition to the right of access, correction and deletion, you can ask us to restrict processing and you can object if you disagree with the processing.
You can exercise these rights by contacting us at info@SourceMonks.nl. To verify your identity, we will ask you a number of identifying questions. We aim to respond within one month of receiving your request.
In certain cases, we may have the right to refuse your request. In that case, we will explain the reasons for our refusal.

SECURITY
SourceMonks takes the protection of your data seriously and takes appropriate organisational and technical measures to prevent misuse, loss, unauthorised access, unwanted disclosure, and unauthorised modification. The SourceMonks website uses a reliable SSL Certificate to ensure that your personal data does not fall into the wrong hands.
